Recent surveys indicate over half of tax practitioners have not yet filed an Employee Retention Credit (ERC) claim on Form 941. Over 75% have not yet filed a retroactive claim on Form 941-X.

What’s the holdup? For many, it’s lack of command and working knowledge of the ERC rules. Another tricky part is how ERC, in competition for the same wages, interplays with PPP forgiveness. Others do not fully appreciate the opportunities for ERC refunds. Others are stumbling over new IRS corporate shareholder guidance.

Bradley Burnett, J.D., LL.M., is a practicing Colorado tax attorney with 33 years of tax practice experience.  His practice emphasis is on tax planning and tax controversy resolution.  He also prepares a handful of tax returns.
